Matt Drake is an associate and experienced litigator in Lewis Thomason's Knoxville office. As  member of the Firm's construction and cybersecurity practice groups, Matt focuses his practice in the areas of construction, contract, and cybersecurity/data security law.

Matt Drake is an associate and experienced litigator in Lewis Thomason’s Knoxville office. As  member of the Firm’s construction and cybersecurity practice groups, Matt focuses his practice in the areas of construction, contract, and cybersecurity/data security law.

Matt represents clients in lawsuits at both the trial and appellate levels in state, federal and administrative courts throughout middle and east Tennessee.  He also advises clients in a variety of matters outside of litigation, including contract negotiation and development, data breach response, construction planning, and policy development matters.

Construction Law.  Timely and effective legal guidance is both an effective way to avoid disputes, and a valuable tool for resolution of existing disputes.  Accordingly, in addition to litigating construction disputes, Matt often assists his clients in navigating the construction process at every phase, from planning to completion. Matt’s construction clientele includes contractors, engineers, architects, suppliers and property owners.

Matt is uniquely experienced and educated in handling public construction project disputes and consults with clients concerning matters that commonly arise on public projects, including bid protests, equitable adjustment requests, default/breach events and bond claims.

Privacy, cybersecurity and data security law.  Matt also assists clients in the areas of cybersecurity, privacy and data security law.  As technology advances, the body of law governing collection, storage and dissemination of sensitive data, and particularly personally identifiable information (PII), continues to rapidly expand and evolve.  Businesses now find themselves subject to complex extraterritorial laws and regulations, including the California Consumer Privacy Act (CCPA) and the General Data Protection Regulation (GDPR).  Compliance with these laws can substantially impact local, regional, national and international operations.  Matt assists his clients to develop privacy and data security policies that fit their operations and are tailored to their market reach.   He provides guidance to clients ranging from small, hometown establishments to large publicly-traded corporations, concerning privacy policies and terms of use, data breach response, notification procedures and compliance with statutory and regulatory requirements.

Matt is a military veteran and currently serves in the Army National Guard.  Over the course of his military career, Matt has served in a variety of duty positions and theatres, from acting as a Scout in combat operations during Operation Iraqi Freedom III, to providing legal guidance to soldiers participating in deterrence operations in the Baltic States.  Recently, Matt served as the Command Judge Advocate for a NATO multinational task force supporting the Enhanced Forward Presence (eFP) mission.  As a result of his experience as an Army Judge Advocate, Matt has unique experience and perspective concerning public contracting and cybersecurity.  Presently, Matt is assigned in a reserve status as the Operational Law Attorney to the Regimental Headquarters of the 278th ACR, a heavy armored cavalry regiment in the Tennessee Army National Guard.

Outside the office, Matt is an advocate for autism research and treatment. He also dedicates time to supporting organizations and events that benefit military veterans.
