We have acted as counsel to Fortune 500 companies, such as FedEx, to small businesses with lawsuits that, if lost, could cause the demise of the business. The corporate departments of several large companies regularly use Lewis Thomason as outside counsel or local counsel in both federal and state courts.

We regularly represent automobile dealers in the formation, acquisition and sale of dealerships and in everyday legal matters of operations such as financing, consumer issues, contract questions, employee relations and regulatory matters. We also handle litigation arising in those areas.

We represent lending institutions – large national banks, small community banks and other lenders of various sizes – as well as borrowers in commercial and consumer loans. We are well versed in Tennessee lending laws and adept in preparing loan documents. We handle a variety of banking and lending litigation matters, from routine collection actions to complex loan workouts to priority disputes with other financial institutions and bank fraud cases. We have represented the FDIC in numerous complex loan workouts, bank insolvency and receivership matters.

With a focus on creditor representation, we are experienced in representing secured and unsecured creditors in commercial and consumer cases under all chapters of the Bankruptcy Code, including litigation over claims, plan confirmation and dischargeability, defense of preference actions and reorganization. Our clients have included banks, finance companies, retailers, wholesalers, manufacturers, service companies and other businesses, as well as municipalities, the FDIC and  individual creditors.

We perform a wide variety of services for private companies, including formation of corporations, partnerships and limited liability companies, buying and selling businesses, and negotiating, drafting and enforcing contracts of all kinds. We handle disputes among business owners, matters of director and officer liability and the dissolution of companies. We also are experienced in the area of employment contracts and non-competition agreements and work with the members of our Employment Law Group on questions of employee relations. We litigate disputes in all of these areas.

Zoning and Land Use

We have practiced extensively before state and local planning, zoning and development agencies and local elected bodies such as city councils and county commissions on matters relating to zoning and land use. Our clients include industrial, commercial and residential developers, landfill operators, billboard companies, wireless telecommunications companies and homeowners associations. We are very familiar with local practices, procedures and government personnel and are able to assist our clients in achieving their goals as expeditiously as possible.

Our attorneys who maintain a significant practice involving municipal zoning have developed solid reputations in zoning through many years of practical experience. They routinely represent clients on a wide variety of zoning issues, including waste disposal, commercial development and construction and residential subdivisions. The majority of Lewis Thomason’s zoning practice is involved with municipal boards and councils that have jurisdiction over zoning issues. Our zoning lawyers frequently go before planning commissions and municipal governing councils or commissions to represent their clients involved in variances and other zoning matters.
