On October 23, 2014, the United States Court of Appeals for the Sixth Circuit handed down a major victory for Lewis Thomason.
The victorious appellate team consisted of Dale Bay, Janet Hayes, Daniel Olivas, and Emily Mack.
The case challenged the very essence of the business of our client and its contractual relationship with companies throughout the United States. The questions on appeal involved a complex set of factual and legal issues pertaining to the unique nuances of the terms of a reinsurance participation agreement and related contractual agreements that were under the protection for a patent granted by the U.S. Patent Office. Specifically, the viability of the arbitration provisions for dispute resolution were challenged and alleged to be a basis for voiding the entire contractual relationships of the parties.
The Sixth Circuit Court validated the arguments presented by Lewis Thomason’s appellate team and vacated the adverse Order with specific instructions to the District Court on remand.
