Copyright and Trademark

Our attorneys help clients navigate the copyright and trademark registration processes and either protects them from wrongful use or helps them license use of the creative work.  Lewis Thomason assists clients with copyright registration with the United States Register of Copyrights, writes and defends copyright infringement cease-and-desist letters, and, when necessary, defends and prosecutes infringement cases.

With regard to trademark, this area of law is becoming increasingly complex, and, although an attorney is not required to register a patent, the United States Patent Office advises that creators seek representation to avert and fix problems down the road.  Lewis Thomason’s trademark attorneys facilitate comprehensive trademark searches with global follow-up mark-infringement monitoring.  Our hybrid in-house and contracted docketing system enables us to manage important deadlines related to keeping a client’s intellectual property in proper active standing.  As with copyright cases, too, we will defend or prosecute trademark infringement cases as needed.

With our technology experience, we regularly draft and negotiate agreements related to technology service providers software as a service (SaaS), licenses for online use of existing media, and hardware leases and purchases.  The Digital Millennium Copyright Act and domain-name trademark issues arising under the Anti-cybersquatting Consumer Protection Act or the Uniform Domain Name Dispute Resolution Policy present unique challenges.  Our attorneys have the experience to expertly navigate these issues.
