Lewis Thomason’s Transportation Group is a full-service legal team designed with needs of motor carriers in mind.  Our attorneys have provided legal services for more than half of the Top 10 largest LTL and Top 10 largest Truckload carriers in the United States.  Our client base, however, also includes multiple carriers with only a few power units.  We understand the business needs of our motor carrier clients, and we have the experience and practical insight to navigate carrier and intermediary agreements, independent contractor and leasing issues, as well as regulatory compliance, business structuring and transactions, litigation, insurance, labor and employment, highway accident defense, taxation, mergers and acquisitions, workers’ compensation, logistics, driver leasing, warehousing, and private fleet operations.

Lewis Thomason has experience litigating cargo and load-shifting claims, hours of service issues, driver qualification allegations, mechanical failures, EDR issues, and other claims that are unique to the transportation industry. We have put that knowledge and experience to work in successfully defending carriers in catastrophic injury cases involving multiple deaths and serious injuries, as well as “low impact” cases involving potentially exaggerated damages claims. Lewis Thomason’s attorneys protect our clients’ interest by working with accident reconstruction experts, cause and origin fire experts, life care plan specialists, economic experts, lost-profit analysts, medical practitioners, and psychological experts. We also have a strong presence in multiple transportation industry groups as we collectively work for better legislative and strategic solutions to problems facing our clients.

Critical Response Team

Every moment following a serious accident is critical.  Recognizing the vital importance of early intervention, we have assembled a critical response team to protect our clients’ interests in the event of an accident, including multiple experienced transportation attorneys who are available 24 hours per day, seven days per week.  With the capacity to be on the scene leading the defense investigation with qualified accident reconstructionists, private investigators, and other professionals, our attorneys can help clients navigate potential evidentiary and other pitfalls that are otherwise all too common following a serious incident.   We take special pride in being able to prioritize employee interviews and care, witness and law enforcement investigations, and federal and state regulatory inquiries during a seemingly chaotic time.  In the past, we have guided clients through investigations conducted by the FMCSA and the NTSB.

“Best practices” Consulting

In addition to handling litigated and non-litigated claims, our Transportation Group is always working to ensure that our clients’ operational and claims processes are the best they can be. We work  with motor carriers of all sizes regarding a variety of issues, including EDR and fleet management data and FMCSA appeals. Our goal is to ensure that after each claim is resolved, our clients are prepared to handle the next one.
